If I may amplify what the Kpt. said,
  • If it running with lights on it is definitely a neutral ship
  • If it is running with lights off it may be a neutral ship.
The only way to know if an unlit ship is neutral is to get close enough to identify the flag. That is why I try to get within a kilometer or so when preparing to torpedo a merchant ship at night, and get a really good look at the flag before letting that eel go.
