Default WTH!

Construction guys are building lots across my street and this is the second time I have caught them stealing water out of my hose! I think it is getting close the time to call the cops.

If they would have bothered to ask!

Would it be legal if they are trespassing on your property and stealing (water)?

No. It is a defensive tool. Much more complicated than that too. This is why we laugh at you Euro misconceptions of American life.

There is a lot more responsibility for a citizen with a gun than is commonly understood.

Shooting someone is only justified in cases where the life of the shooter or someone else's (dependent on the state) life is in direct danger.

The exact details vary from state to state and in come cases county to county. This is why it is so important to know the laws in YOUR state/county.

Generally speaking you can't shoot someone committing a crime where a court could not levy a death sentence.

This is why you can shoot someone who is trying to murder you (murder can have a sentence of death) while you can't shoot someone for stealing your car (GTA does not normally carry a possibility of a death sentence).

This is why that shooting case in Texas a few months ago infuriated many responsible gun owners (including me).

Remember, if you shoot someone it is up to YOU to prove your innocence. There is no presumption of innocence when a citizen chooses to shoot someone.

There are some anti-gun people out there who believe that every gun owner is just waiting to wade in guns a blazin at the slightest provocation.

This has not been my experience. Responsible gun owners live in a sort of "fear" that one day they may be forced to use their weapon, but they are not eager to do so.

Even justifiable shootings tear families apart and ruin lives.

I can highly recommend the book: "In the Gravest Extreme: The Role of the Firearm in Personal Protection" by Massad F. Ayoob for a no BS explanation of firearms for self defense.

If they enter your home , it is justifiable - the latest set of laws sweeping across the country.

Out here, a car thief was seen by the owner not to long back and they killed him. Nothing happened to the owner, though in this case, they beat the thief to death stopping him from taking the car.

PS. Platapus is right though. I want to die an old man never having to have used them for what they are intended for.

The ADA always has the leeway not to prosecute. Personally I would not bet my life on that decision.

I would not shoot anyone who is entering my house, unless there were indications that my life (family's lives) were in danger.

Nothing I have in my house is worth killing someone over.

But that is a personal choice that every gun owner needs to make. Just because you can do something legally does not mean you should do it morally.

But I would never attempt to push my morals on other people in this case.

I hear ya. I don't want to shoot anyone either. Would be hard to live with that I'd think. Though if they are in my house, they probably do not have good intentions for me or my family so they will probably get it.

Reminds me of one of the few episodes of South Park I have ever seen.

Homer has a handgun for home defense.

The cop tells Homer that he can legally shoot someone entering his house

Homer calls out "Hey Flanders, come over here"

The cop tells Homer "Uh, Mr. Simpson, it does not work if you invite them in."

Homer, clearly disappointed says "oh".

So I guess I can't invite one of those political fanatics assaulting our neighbourhood and pop them one?

Simpsons, not South Park

Anyway, it's a pity you can't link your hose up to something else like your sewage tank or something...that'd give them a bit of a surprise when they visit next.

But the more rational thing to do is take pics and talk to the cops, or just turn the water supply to the hose off.

I have a friend who has had three separate intrusions in the past twenty years. On every occassion just the sound of a .45's slide racking has been enough to cause the burglar to take the 'better part of valor' road and skedaddle. Being reluctant to shoot someone in the back as he ran down the sidewalk, my friend has never shot anyone either.
