Patch won't install

Just install the game on the c drive .

Seems strange it's not updating automatically when you first run.
I take it that it is a genuine dvd, not a hookey copy?

All I can suggest is a complete uninstall/reinstall to your C: drive, but not into the Programs or Programs(x86) folders (C:\Games\SH5\ would be a good one).
