1. Certain people illegally downloaded a pre beta version of the addon from the X1 FTP and act like it was the final retail version allready on the store shelves.

Pre beta? Huh?? According to the statement by X1 that the thing went gold more than a week ago initially and the build on the server was from this month also, I can't believe it.

Illegally downloaded? The server was wide open, there was not a single line of any disclaimer to be seen.

3. The package illegally download was a pre beta version with the mods they want(ed) to add to the package. Negotiations if it´s okay to include the mods with the modmakers were, and still are, under way at that point and adding to this a lot of modmakers allready gave their okay to have the mods inlcuded, even before this incident.

It wasn't a pre beta, but the 'gold' version - and, again, nobody did something illegal to download it. Nobody could know from a readme or EULA that this was something other than another free mod pack

5. The included mods are only goodies, including mods to addons packages is no new concept.

Only Goodies? The package on the x1 server had 235 MB, the so called 'proprietary development' in that build was about ~700 kb the max.
