Bloody good idea. There should be more of it. I agree with Neal. Unless you suggest to someone "Hey see that car over there? Go steal it" it shouldn't be entrapment.
If you left my keys in the door or ignition an some basum stole it, it would still be theft. |

Entrapment, according to US law, does NOT apply here. Specifically:
Quote:
By posters' earlier logic, what if a cop hopped out of a squad car to chase a perp, and left the door open and the keys in the ignition? Would it be entrapment for someone to steal the squad? Of course not. |

They started doing these cars in a the late 90s I belive the shows just put it on tv that is all they did not come up with the idea. You can not be entrapped when you are trying to steal a car, you are trying to seatl a car you just stole one that you cant steal
![]() I saw on the Bait Car show a few times people taking the keys and calling the police to report an unattended (unaware it was a bait car) car! ![]() ![]() http://en.wikipedia.org/wiki/Entrapment http://www.slate.com/id/1003657/ Last edited by Stealhead; 07-27-09 at 01:12 AM. |

Seen the show and get a laugh out of seeing when they realize that they are going to be caught red handed!

Reminds me of that Dateline series, To Catch a Predator. There's nothing more ... satisfying than seeing some of these people face the revelation that they've been busted.

No, entrapment as a concept doesn't exist in UK law. The police can set up a sting and if you fall for it, you are arrested.
Your only defence would be if the individual was induced or persuaded by a Police Officer to commit the offence. |

It certainly does*. Some local bobbies fell foul of it in York about four (or five?) years ago when they tried to get convictions of drug dealing by offering drug users unusually large amounts of money to buy illegal substances. The court ruled that in the normal course of events the accused would have not been offered such high prices and therefore would not have been tempted to deal drugs. It made the papers because several officers where suspended and there was an PCC case opened. No idea how it ended up. *It may not exist in the code, but it is certainly exercised by the courts when the integrity of the legal process looks under threat. ed: Liky linky

They should use a Ford Pinto, with locking doors, then hit it from behind.

Hence the defence when "inducement or persuasion" is used.

I was watching The smoking gun presents Worlds Dumbest Drivers, and two of them were about these bait cars.
One is where these two guys get in, the cops pull up behind them, and then the driver starts crying like a little girl becuase he's going to jail. The other one was about a 65 year old grandma who stole a bait car, drives off and then the police catch up. She starts praying to jesus that they'll let her go.
