Where did you heared this? It sounds like bull.. sorry , but I don't belive this could be true. Those aircrafts are not manufactured any more.
What you wrote could be true in a moder racing game wich use existing sport car modells, but not with WWII games and military aircrafts.
Or do you honestly think that the 1.000.000 + 1 WWII games nowdays all pay to all manufacturers ??

Oh believe it. I cant say its the case for SHIV, im not privy to that info, but do believe companys would place such restrictions on devs.
For instance, i believe "BumbleBee" wasnt a volskwagen bettle in the Transformers Movie, because Volkswagen didnt want their car used as a fighting machine. Flight sims tend to not show the crashes because the aircraft manufactures dont want their planes to be associated with crashes, etc, etc.
Everybody wants their cut and/or wants to protect themselves from some preceieved negative image...their laywers are doing a good job of finding stuff to do in order to justifying their presence and high retainers.
