That is not good news.

Were the two aircraft in uncontrolled (VFR) airspace or were they supposed to be under ATC control?

In any case, yeah, some people today just have no manners what cell phones and the use of them applies. At job, in restaurants, shops, supermarkeds etc etc while being served or serving...

Pilot error on both operators (PIC).

I'm not allowed to have a phone on while I'm in the cab of a train, let alone when I'm driving it.
