Were the two aircraft in uncontrolled (VFR) airspace or were they supposed to be under ATC control?

Apparently he was talking with his girlfriend. It was either one of two things:

In any case, yeah, some people today just have no manners what cell phones and the use of them applies. At job, in restaurants, shops, supermarkeds etc etc while being served or serving... :damn:
The answer mashine was invented for this purpose, but today some people just cannot wait....

I'd have thought there would be a standing order preventing the making or taking of mobile calls whilst on duty :hmmm:

In uncontrolled airspace......see and avoid applies. The controller and supervisor are being made the scapegoats.

Pilot error on both operators (PIC).

I'm not allowed to have a phone on while I'm in the cab of a train, let alone when I'm driving it.
