Ok, these are my personal opinions, nothing to do with the rest of the dev team.

If I´d make a list of all the mods that use something copyrighted, the list would circle the earth 50 times. Of course, you are right that we, and you and some other modders here have broken the copyright law. But think about it. Almost everything in commercial games, movies and music records have been copyrighted. Most of the soundpacks made for SHIII are breaking the law, what about the gramophone packs?

The copyright owners have much bigger things to worry about than a one of their tracks used in a freeware mod; piracy.

I don't maintain IuB anymore but there was no music or video from Das Boot used, just a few short sound samples (from other mods, I didn't sample them myself). This would probably fall into the "fair-use" category. Some old 1920's gramophone music was there too, most of which would be public domain by now. I believe the video was added by the maintainer of 1.03, nothing to do with me. I was also going to make a "copyright-free" version of the mod for inclusion on magazine CD covers and so on but never got around to it.

In this case the music tracks are added gratuituously in their entirety and are done so entirely knowingly. It is risky to have that sort of music as part of any mod, so my advice would be to remove it and replace it with original or non-copyrighted music. The music industry has a notorious record for prosecuting even minor cases, which is why I bring this up.

But can you give me one example where mod has been sued for having copyrighted music on it? The loss to copyright owner is so minor, that it is not worth the money nor time to sue a mod. Even Youtube has videos taken from movies and the site is still standing and the videos are there. There is of course always a chance that the copyright owner of the music/movie clip plays the mod and takes action. But I find the chance to be almost as low as winning in lottery.

Dont want to listen to so called " copyrighted " music / sound bites simple
A) Download the mod and remove the sounds
B) Dont Download the mod
C) Download the mod and play with no speakers / headphones plugged in

The very worst thing that can happen is that... if in the very unlikely event that the copyright holders find the mod and actually care about enforcing it in such a fickle thing... then they will ask us to remove it. No big deal.

We are certainly not using their material for profit, we acknowledge it's use, and if anything it's publicity and is to everyone's advantage.

The fact is that GW is better with this material than without it, and it hurts no one.

The music during the main menu and u-boat office screens. I do like no music while at sea though. Hard to hear where that destroyer is otherwise!

Not this copyright issue AGAIN!!!!!! If people are so damned worried about it, then I suggest DON'T use mods, DON'T change ANY aspect of the stock game and DON'T bother buying ANY type of game 'cos as sure as hell there will be some element of copyright issues involved. If you listen to a sound track on your computer via the web, isn't that a breach of copyright seeing that it wasn't purchased?????

As far as I'm concerned, nothing is breached as no profit is gained from it. Perhaps start looking at mods that you do have to pay for Hmmmm!!!

This is my opinion to it all.

Just a little update here. I purchased the soundtrack to the movie "plunkett & macleane" and recieved it yesterday. The opening music used in GW is the title "Hanging" on the CD. I love this music and thought it was part of some classical opus but it isn't.

Anyway, it's an excellent choice to the mod's movie played in the beginning.

If you've watched my NorOps trailer, you've gotten a hint at my policy ("music sampled from [...] Oblivion, legally owned by the maker of the movie"): Using retail music, movie scenes and so on is fine as long as you've paid for them. If you illegally download an MP3 and use it in your work, then that's wrong in my eyes. If you legally buy it, fine by me.

Sounds fair to me: You use their product, they're paid for it.
