I just read that PM now says he did cut up the corpse of Kim Wall but he still pleads innocent on the murder charges. Jesus Christ. I'm really starting to think that the Japanese woman they found back in '86 likely is PM too with him looking more and more like some kind of stone cold psycho. That picture of him at the harbour is quite haunting

The police has decided not to use any further investigation time to search for the missing mobile phones. According to the article, the police has the opinion that it has enough material to make a full charge on PM for the trial. The trial will start March 8th, and presumely, there will be a verdict April 25th.

The police has published a part of the indictment today. According to this, PM has given KW stabwounds while she was still alive. And the stabwounds were in and around the vagina. He will be prosecuted for murder, improper handling of a corpse and another sexual relation than intercourse. Plus some violations of sea laws. In the indictment, the police states that PM planned and prepared the murder of KW. The extact way is still unknown but probably by strangulation or cutting the throat. According to a mental examination of PM, he has been judged fit for a normal emprisonment, but with the option of custody/preventive detention. The fact of having the saw and the metal tubes onboard indicates some sort of planning. This chief thinks the prosecutor will go for custody or life in prison, which shows the importance of this case. He may be considered to be too dangerous to release. A crime will then have been taken place onboard, and that would be the reason for the destruction of the uboat. PM and his attorney has now received the indictment, and they have been reading it together. 7 days later, January 23rd, the full version can be given to the medias. However, the prosecutor hopes that for the sake of the family of KW and for the case in court, that not all of it is revealed untill during the case in court. To be continued....

I am not familiar with the statutes in that jurisdiction.
Is there a risk of the prosecution losing the trial if they can't prove premeditation? I wonder if they have the option of what we call here in the US as Second Degree Murder which does not require proving premeditation.

I have copied some information from a Danish homepage(strafferetshjelpen.dk Here is what it says about murder(killing) "Killing can occur either as intentional killing or negligent killing. Penal Code does not distinguish between murder (killing) and killing. What distinguishes intentional killing and negligent killing is the purpose of the action. If the action has not been taken to kill, but the act has resulted in death, there is no intentional killing, but there may be negligent killing. Intentional killing is the most serious crime in Danish law. Criminal justice is from 5 years of imprisonment to life. Often the punishment for killing without mitigating circumstances is life time or 16 years in prison. An attorney would not take a case to the court if he or she wasn't 100 % if they would win the case. And they wouldn't do this if they didn't have waterproof evidence. Is Danish legal system similar as in Sweden? If so ours is similar too and punishments he is about receive are roughly the same.

As far as I know laws in Denmark and Sweden are almost identical. Sweden is usually ahead of Denmark so my guess would be like Swedish laws 10+ years ago. The only major differences I know of is the punishments, where some things are for cultural reasons not punished as bad in Denmark as in Sweden. Like drunk driving where higher blood alcohol is allowed in Denmark because we are stupid. |

About the different between Danish and Swedish law
Denmark: When a person is arrested by the Danish police, they can keep this person arrested for max 24 hours then they have to take the person to a judge who decide if the police has enough to keep him arrested or if they shall release him. In most cases the judge follow the police and send the suspect back in jail, mostly because they fear the suspect could destroy evidence or the police have already enough but need more time. Sweden: If a person is arrested by the Swedish police, it's the prosecutor who decide if the suspect shall be in custody or released and this shall happen 12 hour after the suspect have been arrested. The prosecutor can keep a suspect arrested 3-4 days before the suspect has to meet a judge, who then decide if the person shall stay ind custody or release. So there is a different between these two countries. Markus |
