By law it is seen as poaching, when you go after fishes owned by somebody, a fish company or a landlord. However, 2 years is the possible maximum penalty only, when you do it for trading and at huge scale and/or at the cost of a second party holding rights or running a business, a fish company in whose facilities or waters you commit the deed.

When you get caught angling fishes that are in a landlord's possession, without having a licence or outside the season, you can expect to get sued for a fee of around around 600-1500 euros (plus fees for lawyers, court procedures etc.), if you did it for private consummation only, two or three salmons for example, and it is your first arrest. If you did it for your own business, then the penalties indeed rocket upwards.

When you fish without licence our outside the season, in a public water, for personal consummation, and the fishes are not the legal possession of somebody, it usually is seen as theft, with according lesser penalties around 50-200 Euros.
