Garion is correct: Xerox's PARC development center did create the first GUI but they did not copyright, patent, or otherwise claim their creation. It was shown freely and publicly to other interested parties (e.g., Apple, MS) and Apple did use it first. When MS started to use the GUI in Windows, Apple sued MS claiming MS stole the "look & feel" from Apple. In court, MS referred back to the Xerox demonstration and Apple's "adaptation" of the GUI. The court ruled Apple had no cliam to the GUI and, with the exception of a couple of desktop icons, dissallowed Apple's claims.
