Default Justice is served...

either way you want to look at it.

This morning i was called to testify against the individual responsible for our April Car Fires. (see http://www.subsim.com/radioroom/showthread.php?t=150559 )

In the end, myself and my wife and two other men were called to the stand.

The offender's entire affluent family of apparent overachievers were present and in notable distress over the behavior of their black sheep underachiever son and what the ordeal has surely put them through as well as myself and the other victims in the neighborhood.

im not some bleeding hearts pansy... but i did feel very sorry for his parents. The heart breaking disappointment they must feel - i wouldnt wish on any parent, but in the end this kid is supposedly a "grown man"... and he made the decision to take a bunch of drugs and drink a bunch of alcohol and go out on the town to set vehicles on fire.

the final ruling on this idiot:

10 years probation

during the 10 years he must spend a yet to be determined period of time living in a half way house while his wages are collected by the state and dispersed to the victims in form of restitution.

he is required to undergo regular random drug testing and alcohol testing.

He is required to take AA for the remainder of his life... any absence from a single AA class or any parole violation of any kind or any failure to secure gainful employment to be used to pay restitution in the next 10 years will result in his return to court for automatic sentencing to a term of 20 years in prison per arson offense... a 180 year sentence.

he claims to understand these terms and has even waived his right to any appeal in the event that he violates these terms in any way shape or form.

from the tone of the judges sentencing and the terminology she used... if he so much as farts in public - his ass is going to prison for the remainder of his life.

after the trial was over, the parents approached me with tears flowing. apologetic for their son's crime.

I hope this young 20 year old will "man up" and make something out of himself.

his ordeal is far from over... he has been given a new lease on life so to speak and hasn't even one chance to **** it up. i wished his parents good luck and left the building.

Sounds like a reasonable verdict, wether or not it will be enforced is another thing.

These type of probation actions slip through the cracks all the time.

Still you must have some small sense of vindication.

Fair sentence. As far as slipping thru the cracks.

The moment your restitution check stops it is your right and Duty to make a phone call.

And it isn't about the money John.

Somebody could have got killed because of his actions.

All in all a fair sentence I should say.
It's just - well, missing a single AA meeting in, say, the next 50 years and he'll end up in jail? It somewhat contradicts the 10 years of probation.
Apart from that, I just hope that he actually has a job and will be able to repay at least a fraction of the damage he has caused. He has already destroyed enough private property, and the very thought of him being on welfare violates my sense of justice.

if he misses an AA meeting while on probation... its jail.

he has x amount of days to secure employment and a number of other stipulations.

Bit strange verdict if you ask me. He gets no immediate jail time meaning he won't have a 'full' criminal record. Hell, maybe no record at all if he can get it expunged later on with the help of family lawyer.

Compare verdicts like this to absolute jail time verdicts that are handed out to many young blacks in the States.
