Default Canada's "Justice System"

Here's a couple of stories I would like to share with everyone, just to get some opinions.

This one is pretty typical.

http://www.cbc.ca/sask/story/charges-stayed0604.html

What do you think is going to be the outcome in this case? The judge seems to be at least somewhat against the pervert though.

http://www.cbc.ca/bc/story/bc_abrosimo20060426.html

The worst thing about this country is a court system that gives offenders even less than a slap on the wrist (an actual slap on the wrist might get the offender a $10,000 settlement ).

I'm not sure what your point is with these two unrelated cases. In the first the charges were stayed due to a lack of evidence against the accused. That's unfortunate but it happens sometimes when you have a system based on the presumption of innocence and require evidence to prove someone guilty of the crime they're charged with. As a Canadian I would rather the odd suspect go free due to a lack of evidence then imprison the innocent on the assumption of guilt.

In the second case you list the man has already pled guilty and is awaiting sentencing so what is the problem there? The Crown is asking for 15-17 years incarceration while the Defence is asking for five to eight with credit for time served. I imagine the actual sentence will probably be somewhere in between but in fact its impossible to predict as it will come down to the pre-sentencing report and what the sentencing judge feels is appropriate.

In neither case do I see anything related to a $10,000 slap on the wrist. Usually when one is trying to make a point like that it helps to actually cite examples of it.

I was just joking about the $10,000 thing. It wasn't meant to be taken seriously, and has nothing to do with either of those two cases.

I just meant to say that there seem to be a lot of cases in Canada which reflect a "revolving door justice system." Maybe these two weren't the best examples, but I have a feeling that sex offender is going to get off lightly. You're right though, it doesn't prove anything. And as for the drunk driving case, it just annoys me how many times it seems I hear of things like this. It is good to know that there is a lower possibility of innocent citizens being convicted, but sometimes it just seems as if the courts are too cautious and there is no level of deterrent or punishment at all. Or maybe the media just reports on the cases which are more likely to get attention (including the ones in which offenders get off lightly when the public would most likely want them to get a heavier sentence).

Just voicing an opinion, not trying to create a flame war or anything.

Cant be as bad as a guy who got sent to court and orderd to pay £60 for using a rubbish bin.

Or for my uncle who got a parking ticket for parking in a disabled bay, even though he had the correct legal badges displayed and on the disability database.

Or for the case im involved with now, all these police are going on is one sentance of a statement against me which is "also im scared for my life because he knows people who can harm me"

Its not the point wether i do or dont, but doesnt this guy realise if i do go down then its going to happen anyway more so if i do go down.

True but here the victim gets a harder time than the criminal, in one case this month a Judge ask the family of their daughter who was rapped. Try to see it from the side of the perpetrator and understand his feelings. What a sick remark, and he got off with a light sentence.

Did anyone read the judge's comment at the end of that second article?

That guy isn't getting off with a year! It's waht the defense's requesting. It's a negociation, at this point... And the defense alway wants to get their people out of jail quick. It's their job.

The other case has a lack of evidence. It sucks, but it happens. That's how the system works.
