Well its official folks, Samsung has been fined mote than 1 billion dollars for patent infringement and trade dress dilution, the biggest ever.
So what was Samsung accused of? Well Samsung was accused of infringing on multiple Apple patents, and diluting the trade dress of the iPhone, but not the iPad. So I am kind of curious here, some people say it is difficult to confuse the Samsung Galaxy S with the iPhone. Well in front of a less tech savvy crowd (compared to the tech sites) here on subsim, do you think you can get confused between these two? Or even better, have you ever even seen a Samsung Galaxy S? Because statistically, I would say everyone has seen it (the Samsung Galaxy S is probably the second most popular single model of phone after the iPhone), Apple argues that on casual examination, people would simply think it is an iPhone. ![]() So far, none of the products in question have been banned yet in the US, that is to be decided at the future date. But than, Samsung has probably appealed before I even finish this post. Now, even more troubling for Samsung, was that on the same day, they lost what was pretty much the same suit as apple on their home turf, in Seoul. Now, 12 Samsung devices, and 3 apple devices are banned in Korea. So what can this mean for us? well I think this is the big break that Microsoft and Nokia needs for windows phone to succeed. I am a Linux evangelist, but only for servers, for phones, I am a Microsoft fanboy. And yet, I have to agree that Windows Phones have not exactly been a stunning success. Yet with this case, I think Windows Phones are going to be pushed hard, much harder, by the cell phone companies, since Microsoft provides legal protection, and that apple even held up a Nokia Lumia as an example that "not all phones have to look like an iPhone". |

I think you are wrong, because there are way too many great android handsets out there for it to have any effect on the smartphone OS market.

Sony Xperia's are far better handsets than the iphones. The Galaxy is far better too and of course they both run the Android system which is again FAR BETTER than Apples. Apple phones are just inferior handsets in a fancy box. Apple just might have to INVENT something new (this will of course be a first for them)

Inclined to agree as i own and use an Xperia Arc S myself, thought about the samsung Galaxy SII, but prefer the feel of the SE, even thoug hthe hardware in the Galaxy is better.

I've got the SII, the phones at work are iPhones and always a problem, some guys have bought the SII to replace them.
MS never really pushed the Windows Phone in the UK, I know one lass with one but she has a new phone every few months so I doubt it'll be around long. MS and Nokia need to spend a lot of money pushing their devices, it's going to take a lot to get this market.

They need to get their smartphone OS's up to par and better than the competition to even stand a chance, the devices themselves are fine.
