Just a question. If AZ defied Judge Susan Bolton's ruling and in spite of that ruling created an even more harsh law (what ever that may be) by Governor Jan Brewer's decree what power would the federal government, other than monetary influence, have to stop it?
The judicial branch has no enforcement arm. The Posse Comitatus Act, precludes the president from sending troops? And the AZ governor is with in her rights to call up her states national guard at will. Would it be a prelude to civil war? Would it be racist? Could you survive such an upheavl? So many other questions arise. Any thoughts? |

Politically such a decision would be suicidal. The platform for Az is the rule of law. To then ignore the legal ruling just because the governor disagrees would be to take out the underpinnings of the entire system in the state. Not only would it be a disaster of epic proportions - it would also evaporate the substantial support across the country that the State has for the law.
They are going about this the right way. Impliment what you can, look at additional changes and fight it out at a higher level. To "throw away the law" in an attempt to enforce law would create anarchy. What law can stand without a justice system - and you can't pick and choose what decisions you like - governor or not.

The US Army, under the auspices of the revised NORTHCOM mission could be used to suppress a rebellion like this.

The frightening theme emerging here is that we are discussing a potential civil war.
additionally, there seem to be those who sympathize with or side with Arizona... and those who seem to want nothing more than Arizona to be bombed into the stone age by the U.S. Military
