Although I feel of the boy and his parents I think this is a real stretch here. They might as well sue the coach because he let them use the bat as well:

Very sad story indeed.
This kid for sure was delt a crap hand. But sue the maker of the bat. ![]() Who are they going to sue next the Kid that hit the ball?

Sue the kid who hit the ball? Anything is possible. Why not go after the glove maker....it was not big enough to catch the ball. They can go after the coach and the rest of the team because they did not say, "Watch out!" Lets go after the grounds keeper because the grass was to high and impeded his ability to get out of the way.
It is endless with people not taking on responsibility for their actions. I'm not blaming the kid here. He got the crappy end of the stick and was in the wrong place at the wrong time. But, I would hope the parents would realize getting hurt while playing sports is a distinct possibility. If these two are home owners they have insurance for the house which sometimes covers things like this, plus any heath insurance policy both would cover expenses. It is a catch 22 I'm sure with these two insurance carriers but to go after the baseball bat company is pure lunacy. Furthermore, what has their lawyer drummed into their head to believe they could possibly win this case?

Totaly agree it is all about the money.
It is very sad indeed with what happened to the kid. But these things can and will happen. The parents must be crazy if they think the company that made the bat are to blame. It is a shame that in this day and age that the family belive the only way they can get the money they say they need to care for they son in his condition is to sue the company that made the bat.

Much as I sympathise with this poor lad, surely he is to blame? The batsman will try to hit the ball, the bat exists to hit the ball, the ball will be hit unless the pitch is good enough. Basically the boy is the architect of his own demise, TBH I'm surprised the batsman isn't suing for the upset and (needless) Guilt he feels and the bat manafacturer for loss of sales. That said I think I might try and source one of these bats for home defence as it's all we're allowed in England...

It would seem that first they would have to prove that if the ball had been hit with a wooden bat the same injury would not have occured. And if they could prove this.. then the next logical culprit would be the league for not disallowing the use of these bats. |
