Sure, people could use it with a UBISOFT product, but that wouldn't mean it belonged to them.

It's a differnet matter it you mod an original file of course. But...

All your base are NOT belong to us.
And even if you used original data the mod is not property of ubisoft. sure, they could sue you for using and redistributing copyrighted material but ownership of your work doesn't fall to them automatically. You own the modifications you made, unless, of course, it's done as contract work or something...
