X1Software assures that the add-on „Seawolves" contains no stolen software and no third-party rights were violated.
The use of every mod has been approved by the respective developer.
All modified sound files were made by the company http://www.incognito-soundworks.com and have been licensed properly!
To be frank, we are tired of getting denounced from anonymous persons here. This has nothing to do with freedom of speech, but rather with the intention of damaging our business. Interestingly enough, the people responsible do not appear with their correct names and addresses, surely because they are afraid of a civil lawsuit or criminal prosecution.
Please do not let yourself be influenced by those devious and cowardly persons. We are more than prepared to face any adversary in court.

This is really interesting.
On one hand you use the anonymity of the internet to secretly download content other people created. Then you modify it and sell it back to the same community that came up with all these ideas.
But when the anonymity of the internet strikes back by spreading the word about what you and your company did you start wining. This has nothing to do with denounciation. It is just the way the net works.
Hasn't this guy been banned a while ago for is questionable behavior on the board?

Trombke, are you mad? You'll get no sympathy here. Everyone on this forum owes the modders much appreciation for their efforts to improve a great game. There's plenty of people who will attest to their mods being taken by X1...read this forum and the Ubi forum. As to there being no contact details, well I can't speak for anyone else but I wouldn't go sticking my name and address on a public forum where every Tom Dick and Harry can read it.

I thought I read somewhere in the Boycott X1 thread that he had been banned. Be a shame if he was banned again too soon....he won't get to read all the nice thiings that I'm sure are about to be said about his company....

It could be that I´m blind, but as far as I know we haven´t seen any real proof yet that Seawolves does indeed contain improperly obtained materials. There are accusations from many sides, but where are the unshakable facts? If anybody knows that, please tell me...

As soon as we have more information about all details, I will post them here! You'll have to wait a little bit. In general I can tell you that I'm talking about the stuff that was included in their "World mod". Parts of it are still in there!

I think he was banned a while ago. But you are really asking the wrong person, I don´t know much about it.
The last question wasn't directed at you personally. Anyway, here is the story so far:
When Combatplanes released World mod they used some of my additional ports (most of them made it into Opd mod) with my permission, and the port escorts and mines. This stuff was still 1:1 in the leaked beta, even though I made it clear that this permission was for non-commercial use only. After the trouble here they have deleted parts of it in the retail versions. Other parts are still in there. How much stuff is still in there? I can't say for sure because I haven't seen all of it, because I don't have SH3 installed and can only use a text editor. I have to rely on others to help me out. This is being done at the moment.
But one thing is for sure: this is very old stuff! Totally outdated!
In fact, the whole addon is nothing but a slightly updated WM!

BTW, I downloaded Incognito Soundworks' SH3 soundpack and began comparing their sounds to those I've got installed (several mods already updated many of the sound files). I personally prefer what I've got already.
Anyone else listen to this soundpack's files?

No. When you look at what you get for the price it´s hard to be objective. It´s a terrible, terrible, terrible product!
Too bad maaaany SHIII players don`t even know that SH has this big community, so they see SW and go 'Wow! An addon with lots of cool stuff!'. Then, some weeks later they find their way here and see that they could´ve have all that for free...

Yeah, I had it a while back. It really wasn't my cup of tea. I liked a few of the sounds, but I sure didn't like the explosion type sounds (torpedoes, guns, etc.). They just sounded "hollow" to me.

First off, what buisness you stole our mods and claimed them as your own, that makes you the Devious ones. Second as if you could really sue each and every one at subsim. My experience with gaming is that 90+ percent play their games/sims offline and arent website and gaming community forum hounds.
Which means, that unless UBI recants their relationship with X1 for questionable business practices, there still is alot of cash to be made even with a loss of 10% of their revenues.
Even if X1 is found guilty of IP theft, then most folks wont know about how the SW product was compiled.
Going forward to protect user IP...

X1 certainly is using mods that the original authors say they never authorized. I have seen one of them - the *.tga file with the AOTD logo. Anyone who has Seawolves can easily check this by going into the game once Seawolves is installed and looking in the Textures\TNormal\tex folder for the *.tga file with the AOTD poster featured in it. It's one of the boat interior shots. According to members of the AOTD clan, they never authorized that X1 could use this mod. X1 says the AOTD clan did authorize its use, or they say that it was an error - the story seems to change depending on what the X1 folks think they can get away with.
The AOTD logo is only the most apparent of the mods that are not authorized to be in Seawolves. The others involve placement of ships and other more complicated stuff. This is why more testing needs to be done to confirm 100% that these mods are stolen. But the fact that X1 is using mods that were never authorized is not in question - I've seen the proof, but I can only prove it to others if they get hold of the Seawolves expansion, and given what I've seen, and what I've experienced in regard to X1 (i.e. how they tried to use other non-authorized mods in the past by cajoling modmakers and holding them to deals that were made before X1 told anyone that their intent was to use the mods for financial gain), I'm not going to suggest that anyone buy the Seawolves expansion.
If X1 didn't 'steal' mods, then the folks behind X1 must be incredibly stupid. Perhaps they simply never thought to ask the modmakers. Perhaps they just modified their own game to their liking and naively decided to just publish the result. Either way, other people's mods were used in Seawolves and X1 is making a profit from mods that were never intended to be sold.

Well, there is also 'word of mouth'. People who are forum hounds also visit computer games stores and have friends who play the game but who may not be internet-savvy. X1 stands to lose a lot more than 10% if we start informing game store employees and our non-internet-savvy friends. I'm fairly sure that if any of us saw Seawolves in our local game store, we'd tell the folks running the store about the scam. 'Word of mouth' has a big effect - in the movie industry it's what can turn an opening weekend movie flop into the 'sleeper' hit of the summer. Let's not underestimate the power of gossip.

If the orginal post is genuine, i find it odd how its appearance more or less coincides with the appearance of the "Improved Uboat" mod.
My guess is this commerical addon is more or less the exact same thing that was created here in public domain.
You know, im reminded of a few years ago. Anyone remember the "addon" CD's back in the Duke Nukem3d or doom Era? They were basically a large collection of modifications and levels accumulated from the internet and sold for comercial profit. Naturally since Bozo's like me didnt use their real names, but an internet handle, any "disclamier" you put in your readme file was probably worth the paper you printed it on.
Kinda sad when you get a couple of scammers trying to package up stuff to make an easy buck at the expensive of the good will of the gaming community. The sad thing about it all, is they'll probably get away with it. They're not the first ones to pull this kind of BS.

You would think that anyone especially a company, would defend themselves with a full list of these things and not just a single link regarding sounds which really weren't in question. X1 probably doesn't have such a list having thrown out the previous list when they were caught red-handed and now have no clue what is really in there since they scrambled to pick out pieces at the last minute. A shoddy well done to you :up: .

Why not have someone represent the modders from this community,
contact UBI directly, and provide the next SH3 Uber-Uboat Update in the correct fashion?
This would do the following things:
1. End X1's hold on this market (stop loss strategy vs. litigation)
2. Provide a legit channel for modders and Subsim to get recognized and potentially recompensed
3. Provides an upgrade patch path that X1 cannot provide
4. Provide TONS of missions (online and multipay)
5. Raise awareness of the online community
And if UBI doesnt go for it, contact a sim magazine and see if they will their CDs that are attached to their magazines.
Im thinking that the release of mods for free need to be done in such a way that if they are wrongfully repackaged for sale, that there be encyrpted tags within the data, or install exes with known MP5 hash codes that make it much harder for them to be redistributed.
Food for thought.
And if X1 is reading this post, great. So you know Capitalism works both ways. If you dont own the source of the IP, then you have a dead end product line. No updates for your SW product apart from the missions and campaigns produced by CP. Im pretty sure that even CP is done with working with X1 in the future.

The Improved U-boat mod is unrelated to X1's priracy. Its the genuine article. X1's a rip off. However, the compiled version that the Improved U-boat mod is, - is a direct slap in the face of everyones favorite pirates.
Its there saying "Hey, you can get the exact same thing here, and you dont have to pay for it!" I think this recent post by Xi (if genuine), show's that they didnt like that much.

For all those people that want the optimize their SHII: they should know where to get the mods for free like they were supposed to....you can't miss it!
I can relate to all the modders that put in their hard work, but discussing this matter is only in X1's best interest.....

What other games have they made? if any. Usually the developers are hot like Blizzard or Electronics Arts etc., then X1 are scratching the surface, and getting desperate by selling such addons as the one they are now doing. I think if someone did hold a law suit against them, X1 would run. To stop them doing this again they need a major charge held against them. In the near future theres no stopping them from making an addon package number II.

The problem is that we are a very small target audiance. The VAST majority of consumers is not even aware that "Improved U boat Mod".
About all this thread has accomplished is getting a few people mildly upset, and actually a few sales for X1 for curiosity (or research) sakes.

Yes, I noticed. There was some X1 tool on the UBi forums posting about how great of a guy Trombke is and that we should feel bad for slandering him or some such nonsense. It was in extremely good English.

I found this in RUB 1.44. It was a fix I made and found. I never got the credit for it. This bug was in the original game.
So maybe I will get some credit for finding this and giving various fixes options?
