hey guys ive decided to try to use v16b1 patch kit and when I patched sh3 I tried to open the sh3 exe and a message said ',windows cant open this file maybe because you don't have the right permission",. what do I do?

Right-click on Patch_SH3.bat. Left-click on "Run as administrator."
Ok I just tried what u said @bigwalleye and here's what's happening. When I right click on the patch sh3 batch and left click on run as administrator the patch comes up saying it can't find a compatible version, but when I don't right click it does say it found a compatible version but when I try to open the patched sh3.exe it still says ," you can't open this file, you may not have the right permission,". And the picture for the patched .exe Isn't the big red SH3 it changes to a paper icon. What do I do?

Why are you trying to open the patched sh3.exe? It's an executable, not a data file. You run it. You don't open it. And there is nothing in the very clearly written instructions provided by h.sie that says anything about opening sh3.exe.
WAEFRTD.

Is the patched sh3.exe in the same folder as HsieOptionsSelector.exe?
Yes I'm saving all of the kit contents in to one folder.

The only other thing I can recommend is to refresh everything, start over, and carefully perform each step.
idk what is happening but whatever I do the same thing keeps happening. after I "patch" sh3 the icon changes from the big SH3 icon to like a windows icon (idk how to describe it) and then when I click on the option patch selector. theres just a message saying ," could not locate SH3.exe,". i really need help!!!!

I'm stumped.
Hopefully other people will come to this thread.
Maybe this has something to do with it. In sh3 commander I set the settings to skip intro movies so when I load the game via sh3 commander it skips the intros. When I load the game from the shortcut on the desktop it plays the intros. Could that be a problem?

You will have the modifications of SH3Comm if you start the game from SH3Comm ONLY. No changes if you start from the SH3 Icon.
