When I run the patch_sh3.bat it comes up with cannot find a sh3.exe that is compatible, what reasons could that be? any ideas please

Is your SH3.EXE file copied into the same folder with the .BAT file? Is the SH3.EXE file the registered original one from Ubisoft without corruption? These are two reasons that the Mod is not working for you. There might be others.

Yes to the first and I have not registered the game since reinstall. I have run mods with jsgm and rolled them back before trying to run the patch
What he means is, is the .exe an unmodded origional one, no other patches having been run on it.

Ok if it has to be just installed and clean then i think not as i have had nygm injsgme run on it. If it has to be clean I understand.

To make it completely clear, it is your copy of the file SH3.exe which must be clean; that is, from a recognised (legal) source, which means purchased on a CD from a recognised retailer, or purchased from Steam.
Moreover, your legal copy of SH3.exe must not have been itself altered in any way by any patch that makes a change to its file structure or code. (You might have added the useful 64-Mbyte RAM game patch for SH3.exe, which has been circulating in these forums for some time - that would not be recognised as a clean version of SH3.exe.)
It is NOT necessary to have registered the legal copy of SH3.exe with Ubisoft.
None of the recognised mods (eg NYGM, GWX, LSH1, War Ace Campaign, to name only those in the SH3 Mods sticky threads) make changes to the file structure or code of SH3.exe.
H.sie's patch does alter the code and file structure of sh3.exe.
However, H.sie's error-trapping routines for patching SH3.exe should make it clear which problem you have:
Either the patch routine cannot find ANY copy of sh3.exe where it expects to find it (ie, in the same folder as the patch .bat file).
Or the patch routine cannot find a recognised copy of SH3.exe.
From your description, it seems that H.sie's patch has found a version of sh3.exe as expected, but has then found that the file does not fit its internal description of a file suitable for use from one of about 5-6 versions that it does know about. There could be several reasons for this: a damaged file, a file incorrectly patched earlier, a legitimate file released by a new source that H.sie did not know about. I am sure that an old SH3 gamer like Rickster would not be using the other possibility, a pirate-sourced file.
If you have previously tried, and failed, to patch your original copy of SH3.exe, then you may have a corrupted file, but H.sie's patch code will provide a back-up copy of the original file as part of the patching process. See if you can locate that original SH3.exe file.

Thanks for your explanation, I am using a legitimate dvd from focus games that is already patched to 1.4, I also have an older version that is not patched to1.4 so I could reinstall this one, would i do H.sie's patch before patching it to 1.4 or after? Many thanks.

Install the Ubisoft 1.4 patch first, then the H.Sie patch second. See if you get better results.

I have the Focus Games CD for SH3 too, pre-patched with Ubisoft's 1.4B.
H.sie's patch works just fine for me. I think the Focus CD is probably the best for patching, because it is the 'cleanest' version around.
Why not just reinstall the whole game from the Focus CD, make several back-up copies immediately of the Focus SH3.exe file, then try to use H.sie's patch again?
