There was an effort by the US government to put an exception into the 1963 treaty to allow for the use of nuclear propulsion for spaceflight, but Soviet fears about military applications kept the exception out of the treaty.

I wonder if anyone has checked lately to see if attitudes have softened?

I kinda think that treaty went out the door when the Soviets tried to orbit their own Death Star in 1987...

I think some of the better evidence is radar tracking and pilot sightings.
