I don't see where you're getting the headline from.

I wonder if Craig would be commenting if it was another politician on trial . The ACLU seems to defend the rights of those who oppose it's existence just as fervently as those who support it.
I can see where the basis for this ruling comes from, but also the arguments against. This quote makes it clear that the ruling is not without basis.
