I doubt getting told to ram a claim will get VW very far.

You're probably right. I suspect it's part a money grab, part "reimbursement" for all the onerous pollution laws forced on the state by the federal govt.

Eh, what passenger trucks only get 10 mpg? I don't know of any.
Anyway, that post was not intended to sidetrack this thread to a Texas deserves compensation theme, simply to illustrate what will surely be a tsunami of litigation that VW can expect.
