1: That depends. Comparing 5 to 3 is comparing apples to oranges. If you are really attached to 3 and you buy 5, prepare to mod the game. Stock SH5 will not satisfy a SH veteran due to its limited UI and its laughably weak AI. Graphics wise, the game is beautiful. However, this beauty is pretty system intensive and can be too much for mid-grade computers. The DRM has been disabled, so that should no longer be an issue. Read some of the other threads to make a decision. If you are willing to work with mod soup, I think you will find it enjoyable.
2: I doubt it. My copy is a digital download, so I have no idea. I have never heard of any issues of this occurring, so my initial reaction is "no".
