I must admit that this time the EU has nothing to do with it. The mess is an exclusive German creation, said to have been build in Bavaria and having been used by the authorities of some some of our 16 federal states.

The worst thing is that Chaos Computer Club says the software is hilariously unsecured, can be "hijacked" by other attackers than the authority having fired it, and then been turned against the victim.

It also shows how very much unrealistic legislation is when it thinks that infiltrating a system and guarding email and communication lines can be allowed - but at the same time prohibiting the active scanning of the HD for criminally relevant data. That is like visiting a suspect in his appartement, but allowing no forming of a personal visual impression and no searching for evidence.

Only bureaucrats sitting at desks in offices without windows can construct such crazy, disconnected ideas. And more and more of our laws get constructed in such absurd ways.

When a judge allows the minitoring of s supect'S PC or laptop,m then the scanning fo the HD should be allowed, too. That implication should be a consideration in the judge'S decision-making.
