I remember seeing signs posted at airports when I was a kid that warned travellers NOT to even joke about bombs, guns, or hijackings when passing through security.

Now, the presence of those signs told me a couple of things. One was that, even under the First Amendment, some things you say can still get you in trouble, not for the fact that they're things you're not allowed to say, but because they're things that maybe you oughtn't say at that particular time and place. The other thing it told me was that enough people are stupid enough to need signs to remind them of this.

I agree with the court's decision based on this. What he said was protected speech, but saying it now, in this desperate and politically volatile time, maybe wasn't the smartest thing to do.
