I think you are right. What is the objective here? The objective seems to be to get Qadaffi out of power and out of Libya. If that is the objective, then this proposed plan is appropriate, however improbable.
Prosecuting Qadaffi from any alleged crimes would be the responsibility of the ICC, not the United States.
This just seems to be an offer for Qadaffi to exchange his "power" for his "freedom" We have made similar offers to other dictators. They usually decline.
