We can't allow a disturbance to continue on because other people's civil rights are being violated. If the man has reserved the spot with the city he's mouthing off in then he's safe to speak as he wishes. If he's just out inciting riots and murder in the streets, he's a public disturbance.

Freedom Of Speech does NOT require government permission.
Best that can be done is to monitor the situation, and see if he does in fact incite a riot.
If not, Constitution trumps Law.
