I don't see this issue, provided the purchase was made unknowingly AND the software is not used. I wouldn't destroy the disc because it is evidence of piracy.
If you purchase a cd under the assumption of validity, then ask others the problem and learn it is pirated does not mean you are guilty of blatant and intentional piracy. It does mean you are out a few bucks with a junk cd. Sorry mate.
What is peaking my curiosity is the issue of the authentic cd. It is not possible to change files on a CD-R or DVD-R. So how did the seller change files on a frozen media, unless he printed off an actual SH4 cd.
