Well i don't understand why a commander had to sit into a vehicle. Commander is a full-time job, if I see the commander going into action i vote to mutiny against him.
If i see a commander taking up a vehicle, (denying the use to the faction), I also tend to vote to mutiny against him. But this doesn't mean there has to be an addictional rule to prevent this, the commander is (IMO) simply doing an error, nothing more nothing less.
Once I've been kicked from a good server while commanding and winning with the reason "learn to be a commander" lol. But after all it was the morning after some excessive party so I said to myself: "OK, I see your point"
