You are very wrong besides the fact of it being a blatent code violation.

The reason for a ground wire is for the case of a phase to case failure the circuit breaker will trip. Thats it... the ground wire serves no other purpose.

There is also possible a low level fault currrent path typically through a human to ground at a very small (but deadly) current level which would not trip a circuit breaker and the current would continue to pass through said human being.

I have tesitified in court as a professional witness for this type of tragic mishap twice. I know of many other engineers whom have done so as well. In fact some make a living off this type of testimony.

Thats why GFI breakers were invented.
