You don't
have to register your work in order to retain intellectual property rights (although you would need to do so before you went to court). That was an infringement, registration or not.
A Creative Commons non-commercial license would be appropriate here (
http://creativecommons.org/licenses/by-nc/2.5/), except I'm sure Ubisoft could forbid it if they wished to. Has Ubi ever commented on how they view modders and their work, vis-a-vis IP, or have they just turned a blind eye (probably the wisest thing to do)?
