Three Men ‘Illegally’ Arrested for Openly Carrying ‘Black Powder’ Pistols in Texas

OK, a few questions.
Does it fall under an open carry law? Was it some law about antique unreliable black powder weapons, being loaded in a public place? Were these men allowed to carry? Legally? I know Texas is cool with guns, but even they got laws pertaining to them. Black powder is an entirely different animal than our current ammo choices, self contained and safe, less prone to misfires. Were these guns loaded? I can see the gripe if so, black powder is dangerous. I cannot see Texas being a Jerk about guns, unless there is a good reason. This ain't NJ |

Look I am pro gun, so not judging these guys, just saying I get the lawmakers point. I also got experience with vintage arms, and they got hair triggers/ fire easily being dropped (let me clarify, trigger pull is hard on these, but a hard drop can discharge them, as opposed to a modern Glock or Sig Sauer handgun.) edit: My experience comes from a family members Colt Peacemaker, I shot for years, I dropped it once and nearly killed one of my uncles pigs. The older mechanisms are just not as reliable, or safe. |

It does not sound like they were illegally arrested if the arresting officers believed, in good faith, that these men were in violation of PC 42.01.
It will be up to the DA to decide whether to press charges (which will probably be dropped). But I don't see anything illegal about the arrest. Of course we are only hearing one side of the issue. |

Just another case of illegal arrest and police misuse of power. They can't use firearm laws, so they make up as they go, such as disorderly conduct and clear not the case in these videos.
My guess is they will have their hands full when people come protesting in mass carrying guns. |
I once got a disorderly conduct charge for 'sleeping on a grassy knoll'.

To continue with the thread hijacking on DC. I got a ticket for disorderly conduct once when I was a kid for mooning a bus with the girls BB team on it...while I was driving...at night. Oh and did I forget to mention I received the ticket by mail after an officer called my house to speak to me about it? Small town and country cops are terrible compared to my experience with police departments from larger cities.
