A federal judge's ruling could pave the way for taxpayer-funded legal representation for immigrants facing deportation in cases of mental incapacity -a move praised by civil libertarians but opposed by advocates of stricter immigration enforcement.U.S. District Court Judge Dolly Gee recently ordered the U.S. government to give two mentally incapacitated illegal immigrants legal representation to fight their deportations. The decision was triggered by the case of Jose Franco-Gonzalez, 30, who spent nearly five years in immigration custody after pleading guilty to assault with a deadly weapon because authorities determined he was too mentally incompetent to represent himself in his own deportation hearings. Traditionally public counsel is not supplied in U.S. deportation cases

If people who kidnap, rape, murder, dismember, and eat small children are afforded legal council, I see nothing wrong with providing the same to people challenging deportation in courts of law.

yes, thats true. Illegally entering this country is a crime, and within these borders, by the grace of god, we are given free counsel if we are accused of a crime. I think its a good move...this is what separates us from places like Iran, no matter who you are in this country, you have the right to have defense in a court of law...not just a privilege that can be taken away if we don't like you.

Yikes, if whats written in the complaint is true this Franco fella got screwed big time. Five years in the poking waiting on a hearing. But hey, what do you expect. They are afforded the luxury of citizens rights and an already over burdened system is expected to cater to them too.
Guess we need to build government hotels, hire border patrol, start a government defense fund, hire more government lawyers and admin personnel too. Lets make sure these illegal immigrants get everything legal immigrants could only dream of. If it were the policy to enforce already existing laws. This Franco guy and others like him would have been deported long ago and this case would not need to be addressed. |
