When the Supreme Court of the United States says it's OK.

That's why we have a Supreme Court. Because the founding dudes recognized that interpretations of law can change.

It's not stacking the deck when there are three vacancies, and the president is supposed to nominate candidates.

Actually one particular founding dude took it upon himself to manipulate the law and single-handedly put the Supreme Court in that position. A lot of folks have either hated him or praised him for it ever since.
