This is all very subjective, and each case should be based on the individual circumstances of the crime.

Using the term 'hate crime' is very emotive, even if the harassment was not actually motivated by hate. Just because someone belongs to a protected category/minority status does not mean that the crime was directed at them because of their race/religion/sex; just in wrong place at wrong time.

Maybe the hate crime label is supposed to act as more of a deterrent to stop vulnerable members of society, i.e. homeless people, being victimised because a hate crime carries harsher penalties if caught.

As for trespassers and intruders in my house - I make no distinction and hate them all equally, and will use the full force of the law to defend my family and home.
