That is correct, but there will be another hearing on 21 Sep 11 to see if, after going treatment, he remains incompetent. If he responds to treatment, he may still go on trial.

Gabrielle Giffords released from hospital
 
The US congresswoman shot in the head in January has been released from hospital to begin outpatient treatment after improvements in her condition.

Gabrielle Giffords of Arizona is to move to the Texas home of her husband, astronaut Mark Kelly.

Six died and 13 were injured in the shooting at Ms Giffords' constituent event in Tucson, Arizona.

The man accused of shooting Ms Giffords and killing six others has been found mentally unfit to stand trial.

I see. This I did not know. I thought perhaps once noted as a loon by the courts you are loon status from then on. I believe he will still be found as incompetent.

Here's how I see it: if you're competent enough to know you would like a gun, buy the gun, buy ammo for the gun, load the gun, then proceed to a very specific event in order to shoot people associated with said even, you are COMPETENT ENOUGH TO STAND TRIAL!

I wish her well in her recovery. I hope that her and her family can move on with life and not have to suffer any further tragedy like this one.

Over 6 billion people on this planet, nobody will miss this one. Keeping him alive is a waste of resources and money that could be put to better use. The "humane" thing to do is put him out of his misery, just like we would for a rabid dog or a lame horse.

Honestly, and I am sure this makes me a bad person, I have never understood why the death penalty can't be applied to mentally ill people.

Who is more of a threat to our society than a nutter who kills people because some invisible friend tells him to?

If they are mentally competent to commit the crime, they should be mentally competent to do the time.
