View Full Version : YouTube blocks most music videos in Finland, including the national anthem

In a bizarre turn of events, today Google blocked thousands of music videos on YouTube in Finland after the company failed to immediately reach a licensing agreement with local performance copyrights agency, Teosto.So... yeah, that happened. :doh: The most baffling thing is how stuff like the German national anthem (Yes, it's blocked) falls under TEOSTO's watch in Finland, or some game music I heard that is blocked.
Jean Sibelius is also on the block list, pieces such as the Finlandia and his military march Jääkärimarssi are blocked.

As far as I know copyrights should expire 50 years after death of artist. However I don't know how exactly copyrights go when someoneperforms piece of music which no longer has copyright. Is that performance fair play or copyrighted?
EDIT: BTW, earlier today Robbie William's 'Feel' was also blocked and stated reason was copyright claim by TEOSTO (that is how YouTube had it spelled, all capitals...). Now atleast this one this one (https://www.youtube.com/watch?v=iy4mXZN1Zzk) works again.

If the original piece has no copyright, then it becomes public domain, so I don't see how someone else performing it would infringe on copyright. :hmmm:

Teosto seemingly has licensed all sorts of music in Finland that has nothing to do with it as AFAIK Teosto only works with Finnish artists. :doh:
@Eichhörnchen: I can see that, but for example the two videos in AVGWarhawk's thread are both blocked.
EDIT: It appears the unblocking has started, still not everything but certainly some that were unwatchable are unblocked now.

I've encountered quite a few "strange" blocks here in the US, but not like what you guys describe...
Teosto (or as YT puts it 'TEOSTO') is apparently a sort of music artists and authors rights administrator, much like ASCAP or BMI here in the US. My guess as to why they are able to have blocked foreign works blocked is the artists have assigned administrative rights to their works in the territories covered by Teosto; the reciprocal of the situation would be foreign artists in the US letting ACSAP/BMI administer and collect royalties for them in the US...

Are you aware that youtube makes $5 billion dollars a year off of advertising
and that was before the red youtube $10 extra a month for no advertising came out?
YT may be raking in the big bucks, but they really want to keep it that way; paying out royalties has been a point of contention all over the world; every entertainment and media entity has locked horns with right administrators for decades and its always about divvying up the revenue pie, with each wanting a bigger slice. I don't know what the issues are in the Finland situation, but its a safe bet Teosto is asking for a sharp rise in royalty rates and YT is not keen on the idea; YT may be able to afford a big bump for Teosto, but then every other nationally local rights administrator would want the same and, most likely, much more than Teosto gets, since each believes their 'stable' is far better than anyone else's; that is where it starts to get into real big bites of the pie; the best course, for YT, is to try to mitigate, as much as possible, any domino effect an agreement with Teosto might cause...

Google and Teosto reached an temporary agreement (reportedly at Google's terms) so any media represented by Teosto was returned to YouTube. Also Jääkärimarssi is now on public domain so it should not have been blocked in first place (and there was many other things that should not have been blocked...).

We had - or still have ? - such a deadlock between a licensing organization (GEMA) and Youtube in Germany, too. I lasted for years, I am not sure whether it still is in place.
