Well it was aired during safe harbor so an FCC fine is doubtful.
Mr. Clemente should really have been looking at his floor manager and not his script so he would have seen the cue that they were on (there are also cues for letting them know how long till air). But that is a newbie mistake.
The sound board operator and director have some responsibility for this one, they really should open the mics with the cue for the talent and not leave the those pots open when the talent is not on air. Not just because what the talent might say but all the extraneous sounds they might make.

Excellent points. With today's electronics there really is no reason for "open mike mistakes" like this. Not that it excuses the reporter.
As a bit of a defense of the crew on set, it should be expected any news professional, rookie or veteran, would deport themselves i a professional manner in the workplace and not depend on anyone else to "save their bacon"...
