I always enjoy walking by the perfume counter at the mall. Last perfume I bought for my wife, a raving beauty would apply samples to her arm and neck and let me smell....
..rather fun or as I age I'm turning into a old pervert.
Beauty and smells sell, not that I care for fake smells being put in the air. The same with color, many stores use color to put you in a certain mood.
So they have finally figured out that allowing the establishment to smell of urine and foot odor is bad for sales.

Care to explain how ?

It's reproduced my article (or at least more than 50% of it) from the Independent without the permission of the copyright holder, ie me. Therefore, copyright infringement.
And the prize for this years "Overreaction of the Year" competition goes to... :shifty:

For the purpose of comment and criticism, wouldnt that fall under fair use ?

Reproducing such a large proportion of the work clearly does not constitute fair use for comment and criticism, particularly when the headline and first paragraph or two would have been sufficient (and would have been compliant with the Independent's own terms and conditions).
Furthermore, the rationale for fair use for comment and criticism is intended to mean works such as reviews, or even deconstructive blog posts, that actually do comment upon or criticise the work. Not website that simply copy and paste it and open it up to a comment facility that does nothing but replicate the one on the source site.

Nah. This one doesn't beat the time earlier this year when an ISP pulled the plug on a site that had stolen my work. (Far more blatantly than this case, I hasten to add.)
As a freelancer, intellectual property rights are all I'm selling. I produce work on the basis that someone is going to pay me to publish that work. I can not then accept other people taking it for free.
So if this guy really is who he says he is then you should delete the post Frei.

I mean I don't want to be a prick, and I'm glad you liked the piece enough to copy and paste so much of it, but I have to protect my copyright.

I've sent a message to the site mods. I'm sure they'll pull it down just as soon as they come online.

Mmm... the article is available for free to everyone already, isn't it? :hmmm:
But, I'm sure Feuer Frei! removes the article once he comes online. :yep:

The Indy's website, like the newspaper, carries adverts. Those adverts pay for staff and freelancers. The more of an article you reproduce (or the more places it is available to view) the fewer views there are on the newspaper's site -- simple supply and demand. The fewer views there are on the newspaper's site, the less advertising revenue they receive. The less advertising revenue they receive, the less freelancers like me get paid.
Which is why I have to be an arsehole about it. Sorry.

Glad to see this resolved. I agree, only a paragraph or two should be copied, with a link to the source.
Does the subtle hint of coffee make you more likely to buy a cup? Does the aroma of piņa colada cause parents to linger in toy shops? Christopher White gets a sniff of the companies using scents to sell.
