And the odds of anyone's calls for anything actually doing anything - are - well - slim to none at best. At the first sign of danger, anyhow, the CIA would be all over them.

that doesnt mean its okay to call for the murder of another person, just because there is a slim chance of it actually happening
At the first sign of danger, anyhow, the CIA would be all over them.
Wouldn't the first sign of danger be someone calling for people to commit murder?
If it was a Muslim calling for people to kill Americans, this thread would have a very different response.

Then... Maybe the President should listen to the people (everyone - not just his side of the aisle - most people from the other side will not both going to one of those rallies so that idea is out) so people don't want to kill him? Professionals estimated the Washington DC national Tea Party rally had over 1.3 million people - the pres. brushed it off and put out a story that there were only 300,000 (it takes more than 300,000 to fill the national mall till people can't move like they did). I'm not going to say whether or not I agree with what the protesters were saying - but the pres. should not have ignored it like he did.
People will get insanely angry when the officials aren't listening to them.
Am I saying its okay for people to call for murder? No. Not at all. What I am saying is that it shouldn't be federally illegal. Besides, I think that the people who would really murder a president are the ones that would NOT be screaming it in the streets and over the internet...

There will always be someone who wants to kill the President. There is nothing a President can do, including doing nothing, that would keep him safe from every nut that is out there.
Regardless of what or who the president ignores there is no justification for death threats.

Agreed - but maybe we need to make a distinction that the 9th circuit may or may not have. Isn't there a difference between "Someone should kill the president." and "I'm going to kill the president."
The first is just an opinion. The second is a direct threat - and that should be illegal.
Maybe the President should listen to the people ... so people don't want to kill him?
So, using threats of violence to influence national policy?
Isn't that the very definition of terrorism?

Personally, I don't think it is even that repugnant if the fella really feels that strongly against Obama.
Let's face it, considering the responsibility placed on them and how many people their decisions can affect, Presidents and other high officials really get it off easy. Wreck the economy and put one million people out of work, worst thing that really happens to him is he doesn't get re-elected. Big deal.
Meanwhile, some lowly criminal that hurts ONE guy gets prison and a conviction record.
There is no way to completely equalize this disparity, but a risk of death for failure would be a start.

I am fairly certain that the so-called Tea Party and it's rallies have nothing to do with death threats against the President of the United States, or so we have been told over and over again by their pundits. That is, of course, unless you would like to challenge that assertion.

In fairness, the American economy was in shambles well before Barack Obama took office. His failing lies within the fact that his administration's efforts have not made ground in turning things around as he promised they would. I would be giving him the benefit of the doubt even if there was evidence of growth; it will take many years to fully recover. However, things continue to look as grim as they did before he took office. For that he must, and will, answer to the American voter. If he is able to make the case for himself, he will be re-elected. If his opponent is able to make the better case, then he will not be.

The fact that the keynote speaker for the rally I was at was in fact an African American proves everything you just said wrong. I remember seeing signs posted at airports when I was a kid that warned travellers NOT to even joke about bombs, guns, or hijackings when passing through security.
Now, the presence of those signs told me a couple of things. One was that, even under the First Amendment, some things you say can still get you in trouble, not for the fact that they're things you're not allowed to say, but because they're things that maybe you oughtn't say at that particular time and place. The other thing it told me was that enough people are stupid enough to need signs to remind them of this.
I agree with the court's decision based on this. What he said was protected speech, but saying it now, in this desperate and politically volatile time, maybe wasn't the smartest thing to do.

Here's my question - why - just because the president is black - do you immediately jump to the accusation of racism?
To be 100% honest, I know a guy that said Obama is better off assassinated (I don't agree). He (the guy) isn't racist in the least bit.
