DETROIT -- A 20-year-old Burger King employee who was arguing with a customer in a crowded fast food restaurant punched the 67-year-old man, who fell and later died, police said Friday.

Will he get any time at all, after all the article says he was being attacked and just hit back.
Surely you should be in favour of the young man as people have a right to defend themselves and are clamouring for laws which mean they never have to retreat from any threats.

The lack of information makes it tough, but even so, about the only charge I could even imagine would be Invol. Manslaughter - but since none of the circumstances surrounding the situation are clear, even that is pure speculation.
Sad, no matter what the causes/reason.

the most the young man is probably looking at is involuntary manslaughter as i think any prosecutor would have a hard time convincing a jury that the fast food worker had "intent" to kill the patron, or that he could have known that simply punching the man in the face could be reasonably expected to result in death.
the sentencing varies in manslaughter cases depending on the details of the case, but i should expect the young man to probably receive a 10 year sentence.
EDIT: found it. it is indicated that the old man tried to hit the worker.
Interesting... if his attorney could justify self defense with the argument being that there is no way the young man could have known the old man would die as a result of that defense then the kid might get away with this

unless the argument escalates to the other person attempting to physically harm you first. Which in this case, based on the story i read the elderly man did not attempt to do.

So does that mean you didn't read the text or cannot read the text as that covers your "unless" to the letter?

Well, on the first part of your statement - meh.
But I agree with the second part - staying one's hand. Knowledge is knowing how to fight. Wisdom is knowing when.

while true... i can count several 67 year old men who could likely kick my ass all day long.
When i was 24 i made the mistake of betting a 65 year old friend of mine that he couldnt kick my ass, as he would tire out.
within 3 seconds of ending that sentence i was face down on the floor totally immobilized.
that was the day he told me about his hand to hand combat instructor days in the USMC
never make the mistake of counting any old dog out of a fight - ever

that day, i gained a lot of both!:o
within a matter of about 3 seconds he had me prone, with my legs crossed behind me, and one arm bent behind my back. While i was laying in this uncomfortable position he was kneeling on my crossed legs in such a way that i couldnt move without the sensation of breaking my legs or shoulder.
his effort during this was minimal.
he said "Now... all i have to do is sit here. I can sit here and wait until the cops arrive or if this were a combat situation i could pull my side arm and shoot you in the back of the head" (while poking his finger on the back of my head.)
i have no idea what that move is called, and it happened so quickly that i have no idea how he actually maneuvered me into such an undesirable position.
I'm glad it was a friendly bet

Yes sir no sir no matter what never argue with them, where was the supervisors they are suppose to step in when it gets heated. Son got a job at the local supermarket those are the rules if it gets heated there's always more than two supervisors near by. He had his first pissed off customer the other day complaining that the prices of wine are to high and 'He' should look into it! lol. I said you should of just told her 'Hey I only work here lady I don't fix the prices'. Not even allowed to say that always has to be Yes sir, or yes ma'am. Anyway the supervisor over heard her and came and sorted it out. If He argues with them he can be fired on the spot.
I think its quite sad whats happened. This young worker probably was under heaps of stress working in a fast food outlet, they have to move fast all day and where the hell was his supervisor out the back having a cigarette I bet! :nope:

The fact that the man died from the assault means either that the younger man was very aggressive in his action or that the older man was rather decrepit. What likely happened was that the customer was causing trouble and smacked the 'whipper snapper', causing the employee to fly off handle.

I remember when my mother approached some credit card salesmen. Judging by their appearance I wouldn't trust them with my particulars but my mother didn't seem to mind.
Couple weeks later we found out that they misled my mother by actually registering her to a completely different bank credit card and made empty promises of a promotion.
So we went back to ask them. Couple minutes later because they were not admitting to lying to my mother I told them that it was amounting to fraud. The guy felt offended and then he tried to punch me in the face but missed. No I'm not the type of guy who are looking for any trouble but this man was just being an *******. He quickly fled the scene while taunting me for a duel.
The place security at first quickly pretended nothing had happened because I'm a Chinese of race but we got it sorted out in the end by bringing the guy to the management office. He lied most of the time and showed no remorse. Just a low life who lied to prospect customers. He was wearing a big cross too on his chest . . . . . . obviously which means nothing to him.
