View Full Version : Making a case for refund

What sorts of game breaking bugs are there that i can tell Stardock exist so i can get a refund?

I mentioned the crew morale resetting to zero after save/load, but never confirmed it myself ( play sessions lasted few minutes and i already uninstalled it)

Any help would be appreciated, i simply refuse to wait for patches and the game as is feels half finished.

Thankyou for any help and please stay on topic i can see this thread turning down a dark road but i'd much like to avoid that.

None, really. There are bugs, sure, but that's to be expected with any software.

About the only reason you should get a refund is if the game fails to function - i.e. very frequent crashes, major graphical glitches, complete unplayability.

Unfortunately, I believe you missed the 'you made your bed, now lie in it' clause of the EULA you retroactively agreed to when you bought and installed the game. Sorry... :D

Might be funny, but also true. Products that don't work as intended or don't work at all can generally be returned for a refund. Games are no exception. I know lots of people got a refund for their Dragon Rising, and seeing all the rants on the forums I think it's safe to assume that SH5 also has its share of issues.

In Germany you will get a refund.

"Fehlen einer zugesicherten Eigenschaft"

means:

Missing of a feature that was promised.

Germany is very customer friendly....

If you are serious about it, you should tell them what you told us, that you feel it is half finished. Just point out to them which features are unfinished and if it fits their return policy, they'll refund your money back.

While I'm not entirely pleased with the product as it currently stands, I wouldn't ask for a refund. The game, as a modding platform, is fantastic, and within a few months I think the modders here in the Subsim community will make it a truly remarkable piece of software. All of the game engine components that made SH3 and SH4 so great are still in there, they just need to be re-enabled.

And, personally, I've had one of my best Silent Hunter moments of all time with SH5 (although it was probably caused by that damn morale bug :o): Yesterday I torpedoed a lone merchant at night not far to the south of Ireland. The ship was sinking slowly, so I decided to wait around for awhile until it finally slipped beneath the waves so I could get credit for my sinking. :arrgh!:

Suddenly, a shell whizzed overhead and a huge geyser of water erupted next to the conning tower of my sub. Apparently, the ship had radioed my position and 2 destroyers were bearing down on me at flank speed, guns blazing. I, or my crew, didn't see them because it was so dark.

Anyhow, it was ridiculously satisfying to run down the ladder, jamming the "crash dive" button, while the sea was churned up by a volley of 5" shells.

Just think like a postage stamp---stick with it. :salute:

@ mobucks If you bought the game preorder style your probably out of luck.

If you did like I did and bought it last Saturday before any preorders even arrived you can if... you paid by Visa or Bank Debit card.

Tell them you didn't get what you paid for and they'll credit your account and tell you to return it to store you bought it at. Been there... Done this.

Btw... Why would you want to retun it ? It's being fixed by our Modders.

I came across a thread of someone on another forum about a day or so ago. He said he brought the game back to Best Buy (I believe it was BB) and they took it back. He said the manager was shocked the game required constant Internet connection and said he was considering a policy to take back the game from anyone who purchased it.

I wish I had bookmarked it. Sorry.

If I run across it again I will def post it up.

I'm trying to get a refund from impulse because, frankly I can't even install it let alone play it.:damn:

It has been nothing but a pain in the asssssssssssssss.

I want to get the game on cd/dvd though, I think it should work if I take that route.

That one's over at the SH forum, I believe it was a Doctor complaining about the required net connection and stated the BB manager couldn't believe it they would do that to a game and gave him his money back..First, being a Doctor, you think he would be smart enough to read the requirements where the game states it needs a connection...as for the store manager that took it back, he obviously is doing a poor job if he didn't know DRM is becoming a standard.

Depending on where you live and where you bought the product, there may be what is known as an implied warranty that the product must be of merchantable quality or fit for purpose.

I know where I am there are consumer protection laws which means that if you sell someone an item which does not work, regarless of your company policy, you must give the customer a refund or offer to replace the product with one that does work.

Check this info http://en.wikipedia.org/wiki/Implied_warranty
But don't accept this as legal advice. Regardless if you talk it up in store the spotty teenager behind the counter and his manager are likely to give up if you sound like you know what you are talking about.

I write and negotiate contracts for a living and these sorts of things are common practise in many jurisdictions particularly in the US and Australia.

Yes, and every EULA contains a disclaimer against Implied Warranties.

The only way that works is if you live in a state (or whatever, if not in the US) that disallows Implied Warranty disclaimers.

That said I have forced returns on particulalry bad/broken game software despite company policies and disclaimers by engaging the local state Attorney General. If you're dead set on returning a broken game and willing to put in the time, there's usually a way.

Contrary to a lot of opinions here I have actually got refunds on several products I was not satisfied with or simply did not work,to include Black Shark.Contact the vendor, state your case and see what happens.Doesn't hurt to try.

thanks fellas

It will indeed be quite a process, i'll keep you guys informed.

As of now, Stardock/Impulse will not give a refund unless they are contacted by Ubisoft via email authorizing a refund. I emailed Ubi technical support and am currently waiting on a response. The only thing i can hope for now is good will on Ubisoft's part.

Hahaha yeah my name has nothing to do with my financial status. I am quite broke and unemployed. My old gamer tag back in '99 was DaddyMorBucks (Annie) But i changed it to something easier to call out over comms (Mo)

Kinda funny since i complain about being broke lately online and people always bring up my name.

[EDIT]
I am aware this game will be awesome after some months/year, however right now im really itching for a new game i can get sucked into so it would just be nice to have my money back so hopefully i can get a good game or at least a decent couple rounds at the bar.

I simply donīt understand why you were thinking this game was bug free.
If I did ask for a refund because of bugs for every game I own, well I didnīt have any games left.
Anyway, good luck.

My first thought was

http://media.comicvine.com/uploads/0/229/88144-108804-nelson-muntz_large.jpg

But once I got over that, the best way I find, is to say (Like most people here it seems :shifty: ) that your wife or girlfriend bought the game for you, but you either don't want it, doesn't meet your system requirements etc or something like that.

Very, very rarely will somewhere not let you return a gift item, at least for store credit.

But it depends on your company's policy on returns, I've had games from the olden days that had a bug that flat out wouldn't run without a patch (This was before I had the internet) due to a runtime conflict, and wasn't allowed to return it, basically unless the disc is cracked or not working on their test PC.

It really depends on your home country. A lot of European countries have "anti-lemon" laws for software but places like the United States consider this a foreign concept (pardon pun.)

If the game literally will not run then you stand a good chance. If you don't like it then you will need luck.

well how bout this. set it aside. come back in a month, and i'm sure by then there will be a decent patch. OR... just pretend you pre-ordered it and wait for it to be "delivered"

If refund is not possible, you can sell it on eBay with the OSP ID.

But I must say, I don't understand people who pre-order or buy the game right away only to regret it. I've tried to warn few people against this compulsive purchase weeks prior to the release, but some people just don't get it do they? I mean really, is it that hard to wait about a week for the reviews to be out before getting the game? I am flabbergasted. :nope:
