ALBANY, Ore. - At the Oaks Apartments in Albany (http://www.ci.albany.or.us/), the management can fly their own flag advertising one and two bedroom apartments - but residents have been told they can't fly any flags at all.

From the building, sure, for technically it belongs to the management company. But if any apartment manager told me what I could not could not display from my automobile, I would just shrug and ignore them.

I think the courts would be interested in a case where a landlord is trying to tell citizens what they can display on their private property.

The worst the landlord can do is say that the renters can't park in the apartment parking lot.. but even that might piss off some judge.

You check the fine print of the lease to make sure your personal transport has nothing to do with a property arrangement, then sue the bastards for malicious prosecution and breach of contract and take the whole apartment block off them.

Ever heard of punitive damages august?
Very handy when you can show the action amounted to malicious prosecution and it means you can not only sue them for actual damages it means you can really take them to the cleaners to teach them a lesson.

Perhaps you had better stick to talking about constitutional issues that you don't know about rather than simple legal issues that you don't know about August. As at least constitutional issues are more complex so you have more of an excuse for not understanding them.:rotfl2:

So the thread I started was about a flag and not being able to display it. It apparently has come from the commie part of the country according to Nikimcbee and no one here knows how to use the legal system but we are ready to pull a slander suit on anyone who attempts to try my patience. :yeah: Excellent!

Thats standard(excuse the pun), it is rented property. the lease contract should stipulate everything from flags, banners, signs, poster , washing lines , outside lighting, window boxes .....pretty much everything really . Add to that local ordinances which cover all buildings and it can get complicated.
The chances are the flag ban on the apartment is perfectly legal and the residents have agreed to it on their lease. It probably only became an issue when they realised they had agreed to it by which time its too late.

The apparent "ban" on flags on vehicles however is another matter entirely .
Property leases do have plenty of clauses about your vehicle and its access/storage on site, also maintainance legal compliance and all that stuff , but flags???? ..... not likely, about as likely as a ban on bumper stickers or personalised plates.

Resident we talked to who had been approached to take down their flags all told us the same thing: that management told them the flags could be offensive because they live in a diverse community.

While I understand what they're getting at here (someone flies an Israeli flag, the other guy gets pissed and puts up a Palestinian flag, etc etc) this is dumb. If you're offended by the American flag, you can (putting on my redneck hat here) get the hell out of America then.

Don't understand what all the fuzz is all about anyhow. So the landlord, for aesthetic reasons, wanted there to be less decorations about. So what? Who said there has to be a thousand flags for every square kilometre of US soil?

Then again, I'm not from a country that obsessively puts the flag on everything from bumper stickers to underwear, so I guess I just don't understand.

No wonder so many people have you on ignore... Was that August? I have her on ignore, so I wouldn't know :D .

You can vote them out but you have little others to choose from (who wants the job, they are basically Politicians), and doesn't seem to matter who gets in anyway the laws never change. There have been a number of times when some of the stupid laws end up on the news, but even then rarely change, the only other way is to protest with signed petitions but even that mostly fails & most residents, like me, just give up/put up!:-?
PS. Don't really call them public servants, more like public masters!!:doh:

That is a simple matter of local planning permission and by-laws
