I'm a man who looks at the cold hard facts before making a decision one way or another. In my research for these facts I came across this.

If I remember my high school U.S. Government course correctly the U.S. Congress is higher in the food chain than the 9th Circuit Court of Appeals. So when Congress passes a bill it becomes law, unless the President decides to veto it. If the President does not veto it the only branch of government left with any authority to repeal said law is the U.S. Supreme Court. So where does the 9th Circuit Court get off that they are higher than the Supreme Court and can countermand what Congress passes at will? Personally I'm tired of hearing about all the screwed up crap the 9th Circuit Court of Appeals is overturning and thinking they have any say over.

Although I see the point in removing a symbol for one faith from public land, separation of church and state being the crux of the matter (pun intended), it is a pretty stupid lawsuit. I suggest the property be sold to a private non-profit, or declared a national landmark as is.
Just for reference, here's a photo of part of the Pacific WW2 Memorial at the Presidio in SF. No cross, but a reference to our Lord.

On further thought, let it be a warning to all churches that their crosses remain attached to the building. Otherwise they're in US sovereign airspace and clearly in violation of the separation of church and state.

1.) It is not the supreme court's duty not to make laws rather to rule on the existing ones. Evidently that fact has been overlooked.
2.) Seperation of church and state is a paraphrase of the first amendment which basically states the goverment shall not mess with your right to practice a religion nor shall they impose any religion upon the public.
3.) ACLU always seems to pick the wrong battle. Something in me says they do this to get there name in the news. We have heard very little from them since during the Obama Campaign. Now they grow restless. Where werre they on the Sotamyer / Fire fighter thing? Where are they on the manslaughter in Iraq?

We are disappointed with today's decision because we believe that the city of New Haven had stronger reasons for believing that its test was discriminatory than the court acknowledged. However, the Court was clear today that employers need to scrutinize their hiring procedures before administering them to ensure that they are fair and non-discriminatory. Moreover, the decision leaves room for employers to take steps voluntarily to assure that discrimination in the workplace is eliminated and to guarantee that efforts to assure fair and equal access to employment can continue.
In other words make the test easier as is being done in the schools. :nope:

If it was still on government land, it should be taken down - it shouldn't have been put there in the first place. From what I could tell, it has no aesthetic or historical significance. It looks like it's just a cross that someone put up, rather than an actual memorial. It is not part of a larger complex or anything like that.
Now that the VFW holds the land, however, they can do what they like.
Regarding the dishonoring veterans bit - what about nonbelieving veterans? Aren't they being dishonored by bringing religion in on something meant to commemorate their sacrifice?

I was trying to find one, but I'd have to go see it again to really know. I don't think it has one anyway, so maybe they thought of this issue before erecting it.

Gah! What a ridiculous situation.
The government should sell off the foot of land at the base of the cross to a
veteran's group at a token price. Problem solved.
