Rape is defined as intercourse or penetration without consent. The argument will be if what happened here constitutes penetration.....

Well if you had read the article you would have seen that the 'wife' decided to not push rape charges.

According to Massachusetts state law ( http://www.mass.gov/legis/laws/mgl/265-22.htm ) either sexual intercourse or unnatural sexual intercourse would be required for it to be rape. Having no idea what they deem to be unnatural sexual intercourse, I would imagine that it would be up to a court to decide if it was rape or not.

That's the strange thing about laws, they have to be interpreted.:hmmm:

Edit : according to http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=ma&vol=appslip/97p1697&invol=1 it does fit the definition.
