Although I feel of the boy and his parents I think this is a real stretch here. They might as well sue the coach because he let them use the bat as well:

This kid for sure was delt a crap hand.

Sue the kid who hit the ball? Anything is possible. Why not go after the glove maker....it was not big enough to catch the ball. They can go after the coach and the rest of the team because they did not say, "Watch out!" Lets go after the grounds keeper because the grass was to high and impeded his ability to get out of the way.
It is endless with people not taking on responsibility for their actions. I'm not blaming the kid here. He got the crappy end of the stick and was in the wrong place at the wrong time. But, I would hope the parents would realize getting hurt while playing sports is a distinct possibility. If these two are home owners they have insurance for the house which sometimes covers things like this, plus any heath insurance policy both would cover expenses. It is a catch 22 I'm sure with these two insurance carriers but to go after the baseball bat company is pure lunacy. Furthermore, what has their lawyer drummed into their head to believe they could possibly win this case?

Totaly agree it is all about the money.
It is very sad indeed with what happened to the kid.
But these things can and will happen.
The parents must be crazy if they think the company that made the bat are to blame.
It is a shame that in this day and age that the family belive the only way they can get the money they say they need to care for they son in his condition is to sue the company that made the bat.
Much as I sympathise with this poor lad, surely he is to blame? The batsman will try to hit the ball, the bat exists to hit the ball, the ball will be hit unless the pitch is good enough. Basically the boy is the architect of his own demise, TBH I'm surprised the batsman isn't suing for the upset and (needless) Guilt he feels and the bat manafacturer for loss of sales. That said I think I might try and source one of these bats for home defence as it's all we're allowed in England...

It would seem that first they would have to prove that if the ball had been hit with a wooden bat the same injury would not have occured.
And if they could prove this.. then the next logical culprit would be the league for not disallowing the use of these bats.

Its idiots like these parents who are responsible for playgrounds and the like getting closed through oz because insurance is skyrocketing.
I broke each and every one of my fingers through both cricket and AFL, they're so badly done that i cant get a wedding ring that will stay in my finger. Maybe i should sue for lets say emotional distress....
i sympathise for the kid and i feel for the parents who needa care for him, but i tell you what, when you do ANYTHING there is a risk involved, just take a bit of responsibility for it. Its unfortunate but it happens, grow up and move along rather than looking for people to blame. the bat-maker?? try the batter, or his parents for feeding him properly so he grew up big and strong...:shifty:

It's not as easy as that. Taking care of a person with those injuries is both difficult and very expensive.

I am certain that somewhere, there's an injury disclaimer that someone had to sign in order to allow their kid to play ball in the little league.
They KNOW someone's going to get hurt if you play a sport. They always set up these things that says, essentially, "I acknowledge that there's a possibility that my kid may be injured, and knowing this, I won't sue if it happens."
Failure to sign means the kid will not be allowed to play.
I know they must have signed such a waiver. I know their attorney is probably looking desperately for a way around said waiver.
"But we didn't know it was going to be this serious, so yr honor, we need to be released from this waiver so we can get money!"

I think that has already happened. I don't remember who did it but someone really tried to sue god because he lets catastrophes happen. IIRC this was just intended to show how ridiculous the American justice system is in which everyone can sue everyone for almost everything.
Does anyone remember the case where this guy (I think he was even a judge) sued a laundry for loosing his pants and demanded several million dollars?
Isn't that insane?

This one hit the news in my monthly BAR (yes, Iīm a lawyer) magazine:
A Charlotte, NC, lawyer purchased a box of very rare and expensive cigars, then insured them against fire among other things. Within a month having smoked his entire stockpile of these great cigars and without yet having made even his first premium payment on the policy, the lawyer filed claim against the insurance company.
In his claim, the lawyer stated the cigars were lost "in a series of small fires." The insurance company refused to pay, citing the obvious reason: that the man had consumed the cigars in the normal fashion.
The lawyer sued....and won! In delivering the ruling the judge agreed with the insurance company that the claim was frivolous. The Judge stated nevertheless, that the lawyer held a policy from the company in which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be unacceptable fire," and was obligated to pay the claim.
Rather than endure lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000.00 to the lawyer for his loss of the rare cigars lost in the "fires."
NOW FOR THE BEST PART... After the lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON!!!! With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000.00 fine.
This is a true story and was the 1st place winner in the recent Criminal Lawyers Award Contest.
I have countless personal (usually acting in behalf of the insurance market) stories about stupid demands:
1.- Someone stole a car from a supermarket parking lot. The carīs owner sued the supermarket for the loss of the vehicle and for US$ 1.000.000 he left unnatended in the trunk.
2.- A man claimed the maid stole his US$ 700.000 ring he left in a suburbian cheapo hotel. Finally, he accepted US$ 300.
3.- Someone hit a parked car (nobody inside it). The carīs owner sued for hair loss and skin problems!
4.- A BMW driver hit a homeless and kill him. The BMW driver sued the freeway for the damage of his car.
5.- A man took the bottom can from a big pile of cans (in display) in a supermarket. The pile fell over the man. He sued the supermarket...and won.
And the last one. In a hearing, the plaintiff was telling how a little mouse came from a tomato sauce can purchased by his client. He was interrupted by one of the defence lawyes, who asked: "Was the little mouse alive?" I was there in behalf of the insurance company of the defence, but I sided with the plaintiffīs in the laughs when someone replied: "yes, the little mouse had a little oxygen tank in there".

There are alot of sad things that have happened and are to come...most of the time when something like this happens, they just want someone to blame..depends on the story. It's all about the money, they do not care about our lives, just theirs. Like cigarretes, the tobacco companies do not care about how many people die because they bought and smoked it even though they knew these risk...the money keeps them in business. Smoking should be against the law. Sometimes OR most of the time in cases like these, law will happen and not justice.
