Charging HP Air below snorkel depth... bug?

I just noticed that DW seems to allow for you to recharge your high pressure air without ventilating and below snorkel depth... This is a bug I'm sure right?

I remember discussion about this. To some small extend this should be possible. Air is supposed to be taken from inside the boat, you should be able to get few % of HP air like that.

If I remember right you can get an extra 10% in this way. It was the same in Sub Command.
